Marriage and divorce

On getting married

Here are some things about super you need to think about:

  1. Consider whether you wish to make (or change) a nomination as to whom you wish your superannuation or pension benefit to be paid if you die. For more information, see Death and disablement.
  2. Think about whether your current insurance cover is sufficient.
  3. If you have changed your name, remember to advise First State Super. Send a certified* copy of your Marriage Certificate, deed poll or change of name certificate from Births, Deaths and Marriages Registration Office to: First State Super, PO Box 1229 Wollongong NSW 2500. Include your full previous name, your full married name, your current address, and your membership number.

*See Proof of identity and document certification for more details

Divorce and super

Federal legislation allows legally recognised couples to divide their superannuation upon the breakdown of their relationship. This means that:

  1. your spouse (or de facto partner*) can obtain information about your super (though we cannot provide your address or other details)
  2. a benefit payment flag can be placed on your account, which stops us from paying your super to you while the flag is in place
  3. your super may be split with your spouse (or de facto partner) either by agreement or by a Court Order.
* This does not apply to de facto partners in Western Australia.
