Question

I have lodged a TPD claim and my disability occurred before 1 April 2011. If it is accepted will I receive the higher amount of insurance benefits available from 1 April 2011?

Answer

The 'existing arrangements' described in the Overview below apply to insurance claims made prior to the introduction of the new arrangements on 1 April 2011.

The arrangements that existed prior to 1 April 2011, rather than the new arrangements from 1 April 2011, apply to an insurance claim made on or after 1 April 2011 where:
  • in the case of a death claim, death occurred prior to 1 April 2011;
or
  • in the case of a total and permanent disablement ('TPD') claim:
    • if you were employed for the minimum hours* and your absence from work due to the injury or illness which caused the TPD claim occurred prior to 1 April 2011; or

    • if you were unemployed, or employed and working less than the minimum hours* on 1 April 2011 (and have not since been employed and working the minimum hours*) and if the injury or illness which caused the TPD claim occurred prior to 1 April 2011;
or
  • in the case of an income protection ('IP') claim, your absence from work due to the injury or illness which is the cause of the IP claim began prior to 1 April 2011.
* The reference to 'minimum hours' refers to the criteria which must be met to qualify for TPD. For more information please refer to the TPD definition in Member Booklet (Product Disclosure Statement) relevant to your division.
