Question

What can I do to get a refund of the 'No TFN tax'?

Answer

If you believe the 'No TFN tax' does not apply to you or you have since sent First State Super your tax file number and you want a refund, you will need to:
  1. Send First State Super your tax file number
  2. Write to the Trustee requesting a refund of the 'No TFN tax' deducted from your account - please provide the amount deducted and the date of the deduction (generally this will be 30 June of the financial year end)
Generally a refund can only be claimed if you supply your tax file number to First State Super within three years of the 'No TFN tax' being deducted from your account.

PLEASE NOTE THAT THIS IS A VERY SLOW PROCESS. Any refund will not be payable until the Fund recovers the amount of tax paid from the Australian Taxation Office. This process can take up to 18 months as the amount can only be recovered when the First State Super lodges its next income tax return.

For example the amount of 'No TFN tax' deducted at 30 June 2008 will first be recoverable through First State Super's 2008-2009 tax return. The 2008-2009 tax return is due to be lodged with the Australian Taxation Office in December 2009. So the refund for any 'No TFN tax' deducted at 30 June 2008 will not be to be paid into a member’s account until early 2010 (at the earliest).

We also need to let you know that a service fee of $100 will be charged to cover the administrative costs of dealing with the Australian Taxation Office in the event that you do provide your tax file number and a refund is required. The $100 will be charged to your First State Super account at the time of the refund.
